SUPPLEMENTAL TERMS FOR WYZE WEARABLE DEVICES

The following Supplemental Terms for Wyze Wearable Devices (“Wyze Wearable Terms”) apply to your use of the Wyze wearable devices, including Wyze Bands and 44 mm and 47 mm Wyze Watches ("Wyze Wearbales"). These Wyze Wearable Terms are in addition to, and not in lieu of, your rights and obligations under the Wyze Terms of Service (the “Standard Terms”), and the Standard Terms are incorporated by reference herein. If there is a conflict between these Wyze Wearable Terms and the Standard Terms, the Wyze Wearable Terms will control for that conflict.

Capitalized terms not defined in the Wyze Wearable Terms have the meanings assigned to them in the Standard Terms.

By accessing, purchasing, or using Wyze Wearables or any Services which interact with Wyze Wearables, you accept and agree to be bound by these Wyze Wearable Terms. If you do not agree to these Wyze Wearable Terms, do not use Wyze Wearables or related Services.

1. NO MEDICAL USES OF WYZE WEARABLES AND SERVICES

Wyze Wearables are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Wyze Wearable data is intended only as a reference. Our goal is to provide helpful and accurate information, but the accuracy of the information collected by Wyze Wearables may be affected by factors such as environmental conditions, skin conditions, how the device is worn, and other end-user interactions. Further, it is your responsibility to determine the appropriate response to all information you receive from Wyze Wearables related Services.

The accuracy of the data collected through Wyze Wearables is not intended to match that of medical devices or scientific measurement devices, and we make no endorsement, representation, or warranty of any kind about the data collected through Wyze Wearables.

2. CONSULT YOUR DOCTOR FOR MEDICAL QUESTIONS

Consult your doctor to assess your health before using Wyze Wearables or starting any new exercise program. This is particularly important if you are overweight, pregnant, nursing, taking regular medications or have any existing medical or health conditions. Wyze Wearables do not determine whether you are physically or medically able to safely participate in exercise routines. If you experience a medical emergency, stop using Wyze Wearables and consult with a medical professional.

Wyze Wearables equipped with heart rate trackers occasionally emit green and infrared light and flashes in order to track your heartrate. A very small percentage of people may experience a seizure when exposed to certain visual images, including flashing lights or patterns, even people who have no history of seizures. Consult with your doctor before using this feature if you have epilepsy or are sensitive to bright or flashing lights, are taking any medicines that can cause photosensitivity, have reduced circulation or bruise easily, have a pacemaker or other internal electronic device, or have carpal tunnel syndrome, hand/wrist tendonitis, or other musculoskeletal disorders.

Stop using if you experience discomfort. For some individuals, prolonged contact with a wearable device may contribute to skin irritation or allergies. If you experience any skin irritation, soreness, or tingling, numbness, burning, or stiffness in your hands or wrists, remove your Wyze Wearable and stop using it. If any of these symptoms persists for more than 2 days, consult with your doctor.

3. USE OF WYZE WEARABLE

You will only use Wyze Wearables in accordance with the Products’ Quick Start Guides and warnings provided by Wyze.

As with all Wyze Products and Services, you must be at least 16 years of age to access, purchase, or use Wyze Wearables. Wyze Wearables are not toys and not intended for use by children. You will keep Wyze Wearables and all their parts and accessories out of the reach of children.
